Financier Ted Cunningham is facing a retrial on charges of laundering money stolen in the Northern Bank raid.
The 63-year-old from Farran, Co Cork, has won an appeal against 10 convictions connected with the £26.5m robbery in Belfast in December 2004, including one charge of laundering STG£2.4m from the Northern Bank raid was quashed.
The 63-year-old from Farran, Co Cork is facing a retrial on nine of the charges, of laundering smaller sums from the £26.5m robbery in Belfast in December 2004.
In April 2009 the financier was jailed for 10 years after a jury found him guilty of laundering more than €3m in total from the Northern Bank robbery.
In this appeal, his lawyers argued the warrant was defective in light of a recent Supreme Court ruling that found S29.1 of the Offences Against the State Act unconstitutional on the basis that warrants must be issued by a Superintendent who is independent of the garda investigation in question.
The court has found that Ted Cunningham is entitled to rely on this decision because his appeal had not been finalised when it was handed down.
A retrial has been ordered
